3.4 - Privileged Mail. Non-Privileged Mail and Mass Communications

Privileged Mail Designation:

Any document by itself may not be considered Privileged Mail. Generally, this designation is applied based on Sender's position. In other words, a document sent only by a practicing attorney or a Public Official may be considered privileged. Therefore, any document sent by anyone who is not a practicing attorney or a public official is treated as non-privileged mail.

Privileged Mail Processing:

Privileged Mail cannot be accessed, reviewed (screened), or processed by TextBehind. Only the authorized personnel at the controlling correctional institution may access privileged mail sent directly by a practicing attorney or a public official. 

Non-Privileged Mail:

Any communication sent by a family member, friend, inmate, organization, or educator regardless of its content is processed as non-privileged mail. There may be a few exceptions to the rule that may apply to the original vital documents, namely:

  1. Educational Transcripts
  2. Medical History Report
  3. Tax Documents
  4. Bank Statements
  5. Passports
  6. Social Security Cards, and so on.

We strongly advise all senders to NOT send original vital documents to TextBehind. However, if you must, send only a copy of such documents to prevent any potential risk of damaging or losing such items. TextBehind does not forward original vital documents to correctional institutions. 

Mass Communication:

A mass communication order is exactly like a "Group Text" where the same document, or a set of document(s) is duplicated for each inmate recipient at a correctional institution selected by the sender.
